Brian D. Kenney

Einhorn, Harris, Ascher, Barbarito and Frost PC is pleased to welcome former Morris County Assistant Prosecutor Brian D. Kenney to the firm as Counsel with the Criminal Law practice group where he will join partner Michael R. Ascher, a former New Jersey Deputy Attorney General and assistant County Prosecutor who has been practicing criminal law for over thirty years.

Kenney will focus his practice on developing strategies for clients to deal with criminal charges or investigations, handling cases from initial investigation or arrest through trial and appeal if necessary. In addition, he will represent clients in Municipal Courts throughout New Jersey.

“Our Criminal Law Practice includes virtually any indictable criminal matter or municipal court matter that can arise in New Jersey,” said Patricia M. Barbarito, Co-Managing Partner of the firm. “With more than 17 years of criminal law experience, including his background as both a county prosecutor and criminal defense attorney, Brian is a tremendous asset to clients charged with alleged criminal violations; he has immense knowledge of criminal defense, domestic violence, law enforcement representation and victim representation.”

Adds Kenney, “I have always practiced criminal law. I believe in the constitution and the rights it affords, along with the basic ideal that individuals are presumed innocent until proven guilty beyond a reasonable doubt. With a solid background in criminal defense, and my work as an Assistant Prosecutor for almost a decade, I strive to provide an attentive and communicative approach to keep clients informed about what is going on every step of the way during what could be the most difficult time in their lives.”

Kenney received his J.D. from Seton Hall University School of Law in 2001, and his B.A., cum laude, from King’s College in 1997. He is a member of the Morris County Bar Association and the Association of Criminal Defense Lawyers of New Jersey. Following graduation from law school, Kenney clerked for the Honorable B. Theodore Bozonelis, A.J.S.C. in Morristown. From 2002 to 2005 he served as an Assistant Prosecutor with the Morris County Prosecutor’s Office; thereafter he practiced criminal defense with Nuzzi & Mason for nearly 8 years. He then returned to the Morris County Prosecutor’s Office from 2013 to 2018 as an Assistant Prosecutor. Kenney was named a New Jersey Super Lawyer “Rising Star” in Criminal Defense from 2009 through 2014 as seen in New Jersey Monthly Magazine.
